    Privacy Notice & Terms of Use

    This Notice applies to all visitors and subscribers ("Users"/ “you”) who visit www.bajajbroking.in, including any associated web pages/microsites (the “Website”), and provide any information to Bajaj Financial Securities Limited (Bajaj Broking). By visiting the Website, you agree to be bound by the terms of this Notice.

    I. What do these terms used in the Notice mean?
     

    a. For the purposes of this Notice:
     

    • “Personal Data” means any data about an individual who is identifiable by or in relation to such data.

    • Basic Identification Details: Name, First Name, Middle Name, Photograph, Signature, Date of Birth etc.

    • Contact Details: Mobile Number, Email ID, Permanent Address, Address Type, Telephone, Fax Number, etc.

    • Identification and Verification Documents: PAN Card, Aadhaar Card, Aadhaar Number, Passport, etc.

    • Family Details: Father’s Name, Spouse Name, Maiden Name, etc.

    • Nominee Details: Nominee Name, Nominee Date of Birth, Nominee Phone etc.

    • Guardian Details: Guardian Name, Guardian PAN, Guardian Signature etc.

    • Banking Details and Financial Details: Bank Account, IFSC Code, Bank Branch, Bank Account Type, UPI ID, Net worth certificates etc.

    • Trading-related details: ITR Statement, KYC Number, Demat Holding Statement, etc.

    • Employment Details: Occupation, Salary Slip, Nature of Business, GST Certificate, etc.

    • Browsing and Analytics Data: Browsing Behavior, Session Time, Links Clicked, Apps Installed, etc.

    • Cookie and Tracking Data: Cookies, Trackers, IP Address, Adobe Analytics Cookie ID, etc.

    • Login Data: Password, OTP, Digi Locker PIN, etc.

    • Social Data: Marital Status, social media, etc.

    b. Services offered by BFSL for which personal data is collected:
     

    • To open a demat account

    • To open a trading account and provide trading-related services (e.g., buy and sell stocks with zero brokerage)

    • To apply for initial public offerings (IPOs) for new investment opportunities

    • Margin Trading Facility

    • For investing in bonds

    • National Pension Scheme

    • Samadhan, which is the service portal/helpdesk of Bajaj Broking, where the User can modify or add to their profile

    • And other services, ESOP Funding, Mutal Funds, Systematic Investment Plan, US Investing, Loan Against Mutal Fund, Loan Against Securities.

    III. Purpose of Collection and Use of Information:
     

    a. We collect Personal Data for the following purposes:
     

    • For opening Demat/Trading Account.

    • To verify customer identity and the information provided by the customer

    • To contact customers to resolve and address grievances and complaints

    • To contact customers to address proactive enquiries/interests and obtain feedback

    • For resolving customer requests for data modifications

    • For sending notifications/messages about real-time market updates and insights from Bajaj Broking

    • For converting lead to account (customer) and then accounts to an active trader (if applicable).

    • To conduct outbound call campaigns for converting a lead to an account (customer) and an account to an active trader

    • To extend services or administer a contest, promotion, survey or other site or business feature;

    • For the purpose of customer data analytics on the website, journey orchestration and personalization across channels.

    • To comply with legal, statutory, and regulatory requirements

    • For finance and accounting activities, including financial statements, TDS, GST, and transactional ledger checks

    • For stock settlement activities, including blocking of securities, payout of securities and delivering to clearing corporations (CC) by the deadline

    • For managing storage infrastructure and access management of the AWS Cloud & Microsoft SQL Server database.

    • For risk control, fraud detection, and prevention

    • To enhance user experience, measure analytics, and support website functionality

    • To conduct training and AI-based skill training; and

    • To monitor trends and personalize your experience

    • As otherwise described to you at the point of collection;

    b. We collect Personal Data only when:
     

    • we have valid, explicit consent from the Data Principal; or

    • processing is necessary for a legitimate purpose permitted under the DPDP Act and DPDP Rules.

    IV. Where do we collect your personal data from?
     

    a. We may collect your Personal Data in the following ways:
     

    • The personal data that you provide when you opt in for our products and services. The data is collected when you interact with us through channels such as our website, mobile applications, physical forms/agreements, business applications, third-party digital channels, and other third parties, as well as during the usage of our products and services. For example, when you reach out to us using the Website “Contact Us” form.

    • Bajaj Broking uses cookies and similar tracking technologies to enhance user experience measure analytics, and support Website functionality. Users may manage cookies through browser settings. Bajaj Broking hereby informs the Users that the Website uses cookies and may store some information on the User's computer in the form of a "cookie" or similar file. Most web browsers allow users to exercise control over such files on their computers by erasing them, blocking them, or notifying the user when such a file is stored. Website users are requested to refer to their browser's instructions to understand about those functions.

    • We also collect data about you on our Mobile Apps by using the appropriate “Permissions” that you provide to us. We collect Personal Data about you via our Mobile Apps using permissions such as camera, location, microphone, phone details, storage, etc .

    V. Rights and Duties of Data Principals:
     

    • Under the relevant Data Protection laws, you have the right to:

    • Confirm whether your personal data is being processed.

    • Access a summary of your personal data processed by us.

    • Correct or update inaccurate or incomplete personal data.

    • Request erasure of personal data that is no longer required for the purpose for which it was collected.

    • Withdraw consent previously given.

    • Appoint a representative to exercise rights on your behalf.

    • Lodge a complaint with the Data Protection Board of India if you believe your rights have been violated.

    • Any grievances must be acknowledged and to be resolved within 90 days.

    • The consent can be withdrawn by writing to DPO@bajajbroking.in and unless it is mandated by law to continue processing or holding your Personal Data, BFSL and its processors/sub processors will cease to process your Personal Data on receiving your request for consent withdrawal in writing.

    • If you are unable to get your request or grievance resolved through the mechanisms provided by BFSL, you will have the right to raise a complaint with the Data Protection Board of India once it is constituted and operational.

    b. Duties of Data Principals: In addition to the rights, the data principals have certain duties such as providing accurate information, not impersonating others, comply with law and avoid false or frivolous grievances. 

     

    VI. Disclosure of Information:
     

    • We may disclose your personal information to authorized third parties (including our affiliates, group companies, successors, service providers, vendors and partners) and service providers, subject to suitable confidentiality obligations, and in accordance with contractual terms, applicable laws and your instructions, who assist us in delivering our products and services, processing transactions, and supporting our operations. These include, but are not limited to, regulatory and market entities, technology and authentication partners, communication and engagement platforms, analytics providers and other service providers.

    • We may also use your Personal Information to provide you with information on products and services offered by our affiliates that are interested in serving you or any of your subscribed services and any service-related activities such as collecting subscription fees from you for those services, and notifying or contacting you regarding such services.

    • All such disclosures are made strictly for business purposes and in compliance with applicable laws. These third parties are contractually obligated to maintain the confidentiality and security of your data and to use it only for the purposes specified by us. We do not sell or rent your personal information to any third party.

    • We may also share information when required by law, regulatory authorities, or to protect our rights, property, or safety, or that of our customers.

    • We collect only such personal data as is necessary to achieve the purposes for which it is processed. We do not process personal data for unrelated or secondary purposes without obtaining fresh consent from the Data Principal.

    VII. How do we secure your Personal Data?
     

    a. We endeavor to put in place high standards of security to protect your interests. You are responsible for ensuring that your User ID and/or Password /MPIN/OTP are not compromised by knowingly or accidentally share, provide or facilitating unauthorized use of it. Failure to do so exposes you to the risks of fraud and loss. BFSL is complying of the requirements of DPDPA, SEBI and other sectoral regulations. BFSL and/or its member companies will not be responsible for losses suffered by customers as a result of:

    • Input errors or misuse of its internet services;

    • Negligent handling or sharing of Password /MPIN

    • Leaving a computer unattended during an online session;

    • Failure to immediately report known accidents of unauthorized account access.

    • Bajaj Broking will never ask you for your Password, MPIN, OTP in order to ensure that you are the only person who knows this information.

    • You should safeguard your unique User ID and Password MPIN, OTP by keeping it secret and confidential. Do not share your User ID and Password MPIN, OTP with anyone or write them down, as you are responsible for all transactions undertaken with your User ID and Password, MPIN, OTP.

    • Ensure that no one can see your Password, MPIN, OTP when you log in to our system.

    • When choosing your unique User ID and Password, MPIN for the first time, do not create it using easily identifiable information such as your birthday, telephone number or a recognizable part of your name.

    • You should safeguard your unique User ID and Password by keeping it secret and confidential. Do not share your User ID and Password with anyone or write them down, as you are responsible for all transactions undertaken with your User ID and Password

    • MPIN, OTP for the first time, do not create it using easily identifiable information such as your birthday, telephone number or a recognizable part of your name.

    • Change your Password regularly. Do not recycle your recently used Password.

    • The same Password and MPIN should not be used for different websites, applications or services particularly when you relate to different entities.

    • Do not select the option on your browser for storing or retaining User ID and Password and MPIN.

    • If you think your User ID and/or password / MPIN has been disclosed to a third party, is lost or stolen and unauthorized transactions may have been conducted, you are responsible to inform us immediately.

    b. It is advisable to take the necessary precautions to protect your personal computer against viruses and other malicious programs. Besides damaging and/or destroying data, viruses and malicious programs can capture your Password and MPIN keystrokes and other personal information and send them to another person without your consent. Some precautions to take:
     

    • Ensure that you install an effective personal firewall, anti-virus, anti-spyware as well as anti-Trojan horse software. These should be updated regularly.

    • Do not download any software from a website that is of doubtful origin.

    • Do not open any email or attachment that is from a source unknown to you. When in doubt, delete such email without opening it.

    VIII. How long we keep your data?
     

    • We keep your personal data only for as long as it is needed for the stated purpose and/or as required in compliance with a regulatory requirement (for example, opening your account, servicing trades, or complying with law). When the purpose is over or if you withdraw consent, we erase the data unless a law requires us to keep it longer.

    • If you don’t use a service for a period specified under the Rules, we will treat the purpose as no longer served and start erasure. We will notify you at least 48 hours before such deletion, giving you a chance to keep the account active.

    • For security and audit, we retain processing logs and related technical records for at least one year (or longer if another law requires it) before erasure.

    • The transaction data is retained for a period of 8 years according to SEBI Regulations.

    IX. How do we ensure Children’s Privacy?
     

    • We collect and process children’s personal data strictly for regulatory and statutory purposes, including recording nominee details and facilitating trading account opening for IPO/ Mutal Fund/ SGB-related activities. Such data shall be used solely for lawful compliance and accurate account administration

    • A child is anyone under 18 years of age. We do not process a child’s personal data without verifiable consent from a parent or lawful guardian.

    • We do not engage in tracking/behavioral monitoring, profiling, or targeted advertising directed at children, and we avoid any process likely to have a detrimental effect on a child’s wellbeing.

    X. Personal Data Breach Notification

    If something goes wrong with the Personal Data that we hold, 
     

    • If we become aware of a personal data breach, we will notify the Data Protection Board of India and inform affected individuals without undue delay, in the manner prescribed. We also provide a followup report within 72 hours with details, impact, and steps taken to fix the issue.

    • Our notice will explain what happened, what data may be affected, what you can do to protect yourself, and how to contact us.

    • Where applicable, we also comply with CERTIn and other sectoral reporting requirements.

    XI. CrossBorder Transfer of Personal Data
     

    When data moves outside India
     

    • We may transfer personal data to service providers or systems outside India (for example, cloud hosting or support operations). Under the Digital Personal Data Protection Act and Rules, such transfers are allowed by default unless the Central Government restricts certain countries/territories via notification. We will comply with any such restrictions.
    • We use contractual and technical safeguards and ensure recipients process data only for our stated purposes and keep it secure. Where specific localization rules apply, we follow those stricter requirements.
    • Significant Data Fiduciaries (if we are designated as one) may have additional obligations on crossborder transfers under the Rules; we will implement any such measures notified.
    • All the Personal Data processed by BFSL is localized in India and not transferred outside India as per the requirements of SEBI.
